Terms of Use

Draft — not yet in force

The operating entity behind Unbeaten Season has not been named in this document yet. Until it is, treat this page as a draft rather than a binding statement.

The short version

  • A free game, made for fun. It is not an official product of any league, club or player, and nothing in it is affiliated with or endorsed by one.
  • You need to be 13 or older.
  • There is no account. Your progress lives in your browser, and if you clear it, it is gone — we cannot bring it back.
  • Play fairly. Scores set by bots or exploits get reset.
  • Scores are worth nothing in money and are not a prize competition.
  • Nothing here takes away rights you have under the Australian Consumer Law or the consumer law where you live.

A plain-English summary, for orientation only. The numbered sections below are the ones that count.

1. These terms, and who they are with

These Terms of Use are an agreement between you and Unbeaten Season, who operates Unbeaten Season at www.unbeatenseason.com from Australia.

By playing, you accept them. If you do not, the remedy is straightforward: do not play. Our Privacy Policy forms part of these terms.

2. What Unbeaten Season is

It is a game. You draft historical players and a simulated season is played out. It exists for entertainment and nothing else.

Every result the game produces is fictional. Seasons, ladders, awards and scores are generated by our own game logic. They do not describe, predict or represent the real performance of any player, club or competition, past or future, and they are not a source of fact about anybody. In particular, nothing here is intended or suitable for use in betting or wagering of any kind.

3. Independence, and other people’s trade marks

This is an independent fan project. It is not affiliated with, endorsed by, sponsored by or associated with the Australian Football League, the AFL Women’s competition, any club, any players’ association, or any player — nor with any other league or governing body whose sport may appear here in future.

How we hold that line, so that you can judge it for yourself:

  • Player names and statistics are facts, drawn from publicly available records. Facts are not owned by anyone, and we present them as facts about a person, never as a badge of endorsement.
  • We use no logos, mascots, wordmarks, club letters or official typefaces. The crests in this game are generic shapes — stripes, hoops, a sash, a V — rendered in a club’s two colours. They are our drawings, not anyone’s marks.
  • We use no photographs and no official imagery. Every visual in this game is drawn in code.
  • No league’s name or initials appear in our product name, our domain, our app name or our icon. Where a competition is named, it is naming the subject of a page, in the ordinary descriptive way any statistics site does.

All third-party names, trade marks and other intellectual property remain the property of their owners. Nothing in this game asserts a claim to any of them.

If you own a mark and something here concerns you, we would genuinely rather hear from you than from your lawyers. Write to privacy@unbeatenseason.com and we will look at it promptly.

4. Who can play

You must be at least 13. If the place you live sets a higher minimum age for using an online service without a parent’s consent, that age applies to you instead.

5. Your identity and your progress

There is no account, no password and nothing to sign up for. Your browser holds a random ID and your game history, and that is what makes you "you" here.

Please take this in before you get 200 games deep:

  • Your progress lives in one browser on one device. There is no account behind it and no automatic backup. It does not follow you anywhere on its own.
  • Moving it is something you have to do deliberately. The device-transfer feature will hand your record to another browser, and it is the only way across. Until you use it, the copy in front of you is the only one.
  • If you clear your site data, use private browsing, or switch device without transferring first, it is gone. We cannot restore it. There is no record on our side that could be matched back to you — see the Privacy Policy for why.
  • You are responsible for your own device. Anyone who can use your browser can use your progress.

Share links — a challenge, a lineup, a result — are unguessable but not secret. Anyone you send one to can open it, and so can anyone they forward it to. Send them accordingly.

6. Handles, league names and anything else you type

You choose your own handle and your own private league names. They must not be obscene, hateful, harassing, or an impersonation of a real person, a club or an official body, and they must not be advertising.

We filter the obvious cases automatically and we may remove, change or reset anything that gets through, with or without notice. By submitting a handle or a league name you give us permission to display it publicly within the game — which is, after all, the point of it.

7. Fair play

The boards are worth looking at only if they are honest. So, when using this game, do not:

  • use bots, scripts, or any automated system to play, to submit scores, or to collect content from the game;
  • exploit a bug, a glitch or an undocumented behaviour to obtain a score, and please tell us if you find one;
  • manipulate leaderboards, streaks, challenges or private leagues by any means, including creating multiple identities to farm them;
  • attempt to break, overload, probe or circumvent the security of the site, or test its vulnerabilities without our written permission;
  • harass, abuse or threaten other players through anything the game displays;
  • collect or harvest other players’ information;
  • scrape, copy or extract the game’s data — the player database, the ratings, the card and rarity system — whether to build a competing product or otherwise;
  • use the game for anything unlawful.

Where we reasonably believe any of this has happened, we may reset or remove scores, streaks, handles, leagues or challenges, and block access to the game. We will act proportionately, but we do not intend to argue about it at length.

8. Leaderboards, private leagues and challenges

These are public or semi-public features and they are optional. You can play everything without ever submitting a score.

  • Scores have no monetary value. They cannot be redeemed, exchanged, transferred or sold, and they are not property.
  • This is not a prize competition, a lottery or a trade promotion. There is nothing to win.
  • Boards expire. Daily, weekly and league records are deleted on the timetable in the Privacy Policy. A place on a board is not a permanent record of anything.
  • We may reset or adjust boards where it is needed to keep them accurate or to correct abuse.

9. Availability, changes, and what happens if we start charging

The game needs an internet connection and depends on services we do not control. We do not promise it will be available, uninterrupted or error-free, and we may change, suspend or discontinue any part of it — including a whole game mode — at any time.

The game is free today. We may introduce paid features in future. If we do, they will be clearly identified as paid before you can buy anything, they will come with their own terms covering payment, refunds and your consumer rights, and nothing you have already earned for free will be put behind a paywall retrospectively.

10. Accuracy of the data

The historical player information in this game is compiled from public records. It will contain errors, omissions and gaps, and it may be out of date. Ratings and positions are our own editorial judgements made for the purposes of a game, not objective measurements of anybody.

Do not rely on any of it as a source of fact. If you spot something wrong, tell us at privacy@unbeatenseason.com — we do fix these.

11. Our intellectual property

The game itself — its code, its design, its writing, its artwork, the Unbeaten Season name, and the draft, scoring, card and rarity systems — belongs to us.

You may play it, and you may share your results and screenshots of them freely, including publicly. Beyond that, you may not copy, adapt, reverse engineer, decompile, redistribute or make commercial use of the game or any part of it without our written permission.

If you send us feedback, a bug report or an idea, you are giving us permission to use it without owing you anything. We are not going to run an ideas-submission process, and we would still rather hear it.

12. Warranties and liability

First, the part that overrides everything else in this section. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, or under any other consumer protection law that applies to you and cannot lawfully be excluded. If any part of this section conflicts with such a law, that law wins and the conflicting part does not apply to you.

Subject to that: the game is provided as is. To the maximum extent permitted by law we exclude all warranties that are not expressly stated here, including as to availability, accuracy, fitness for a particular purpose, and freedom from error.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data, loss of progress, or loss of profits, arising from your use of or inability to use the game. Where our liability cannot be excluded but can be limited, our liability is limited — at our option — to resupplying the service or paying the cost of having it resupplied.

This is a free game made by a small operation. We think that is the right context in which to read the paragraph above, and we have deliberately not attempted to impose an arbitrary cap in dollars, a compulsory arbitration clause, or a waiver of your right to take part in a class action.

13. Indemnity

If you break these terms or misuse the game and that causes a third party to bring a claim against us, you agree to cover the reasonable costs and losses we incur as a result. This applies only to the extent the claim was caused by your own breach or misuse.

14. Ending things

You can stop playing at any time. That is the whole process.

We may block your access to the game if you breach these terms or use the game unlawfully. The sections on independence and trade marks, intellectual property, liability, indemnity and governing law survive after these terms end.

15. Changes to these terms

We may update these terms. The current version is always on this page with its date at the top, and continuing to play after a change means you accept it. If a change is material, we will flag it in the game rather than relying on you to re-read this page.

16. Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.

Non-exclusive matters: if the law where you live gives you the right to bring proceedings in your own country, or gives you consumer protections that cannot be contracted out of, this clause does not take that away.

And before any of that — write to us at privacy@unbeatenseason.com. Almost everything is fixable that way.

17. General

  • If a provision of these terms is unenforceable, it is severed and the rest continues to apply.
  • If we do not enforce something immediately, we have not given up the right to enforce it later.
  • These terms, together with the Privacy Policy, are the entire agreement between us about the game.
  • You may not transfer your rights under these terms. We may transfer ours if the game changes hands, and this agreement would carry over unchanged.
